Personal Data Processing Policy - SOLUFACIL S.A.S
Scope
This Personal Data Processing Policy applies to all personal data and information provided to the company SOLUFACIL S.A.S (hereinafter “SOLUFACIL SAS” or the “Company”); entered on the website www.efacturity.com; or included in the Software provided by Users to create profiles that allow access to the services offered by the Company.
Data Required by SOLUFACIL SAS
Access to the “efacturity” program applications, available at www.efacturity.com, requires the following personal data for verification:
- Personal data: name, identification number, and contact information.
- Access data: username and password.
- Authentication data.
- Other user data depending on the service acquired.
- Data and documents necessary to verify the identity of applicants.
Data Processing
Personal data entered by the User will be processed responsibly, ensuring confidentiality and implementing effective administrative, technical, and physical security measures to prevent alteration, destruction, use, access, or unauthorized disclosure. The User acknowledges and agrees that the personal information entered on the efacturity website, the Software, or provided to the Company will be used for the following purposes:
- Provide Electronic Invoicing and Point of Sale services.
- Offer support and maintenance for Electronic Invoicing and Point of Sale services.
- Provide support for key storage.
- Verify accounts and activities, combat harmful behavior, and detect unusual activities to maintain product integrity.
- Communicate with Users about the Company’s products and services, as well as to share terms and conditions.
- Consult, maintain, or report to any financial, credit, or commercial database operator regarding the User’s commercial, financial, and credit behavior.
- Process suggestions, requests, complaints, or claims to ensure better service for Users.
- Send information requested by Users or deemed useful, including information about the Company’s products and services, unless the User explicitly states they do not wish to receive it.
- Send communications related to SOLUFACIL S.A.S’s commercial activities, news, offers, event invitations, job offers, advertising, and/or surveys about our products or services and those of our business partners.
- Process usage data of our products and/or services for statistical, marketing, or relational analysis purposes.
Disclosure of Information
In accordance with the Electronic Commerce Law, Electronic Signatures, and Data Messages, and ARCOTEL resolutions, SOLUFACIL SAS is obliged to ensure the secure protection and preservation of Users’ personal data obtained in the course of its activities, as well as maintain confidentiality, except in the following cases:
- Request for information by regulatory or control entities.
- Request for information by administrative and/or judicial authorities.
- When the information is or becomes publicly known and/or is part of any public archive or record.
Access and Rectification
Regarding access to Users’ personal data, SOLUFACIL SAS will provide:
- Automated mechanisms for accessing, verifying, and rectifying personal data and any information provided to the Company.
- All information related to the service acquired by the User.
Changes to the Privacy Policy
SOLUFACIL SAS will update its Data Processing Policy when deemed necessary or when the regulatory authority authorizes new activities involving personal data handling. These changes will be notified via email to Users or through a notice on the Company’s website before they take effect. Users are recommended to periodically review the institutional page for updated information on privacy practices.
Use of Cookies
The website currently uses cookies to identify users arriving from social media posts by SOLUFACIL SAS, for web analytics tools to track website usage, manage events, deliver advertising, enhance user experience, and more. SOLUFACIL SAS will not share personal data, except with companies within the same SOLUFACIL SAS group.
Security of Personal Data
SOLUFACIL SAS protects the confidentiality, integrity, and availability of information provided by Users through firewalls (UFW), restricted ports, and confidentiality agreements with personnel. Only the HTTPS port for the web application is exposed to the public.
Legal Basis for Data Processing
SOLUFACIL SAS bases its data processing on:
- Articles 66 and 92 of the Constitution of Ecuador.
- Electronic Commerce Law (Articles 5, 8, 9).
- ARCOTEL Resolution No. 477-20 CONATEL 2008.
User Obligations
- Not to damage, disable, modify, or impair the electronic channels accessed or their stored content.
- Not to use modified system versions to gain unauthorized access.
- Notify SOLUFACIL SAS of any issues with access to provided services.
Responsibilities of SOLUFACIL SAS
- Solely responsible for the processing and use of personal data obtained directly.
- Disclaims liability for improper use by the User.
- Not responsible for the accuracy of information provided by Users or third parties.
